1. Definitions
- "Platform": The Civil Hive web and mobile application operated by Quite Ignite.
- "Company" / "We" / "Us": Quite Ignite, the owner and operator of the Platform.
- "User": Any registered individual or entity using the Platform.
- "Service Provider": Contractors, subcontractors, consultants, suppliers, or professionals offering services through the Platform.
- "Client": Individuals or entities posting tenders or seeking services on the Platform.
- "Tender": Any work opportunity posted on the Platform.
- "Project Data": Schedules, progress records, photos, documents, and communications related to projects on the Platform.
2. Scope of the Platform
The Platform Provides:
- Location-based discovery of tenders and service providers
- Digital tender posting and bidding functionality
- Project scheduling tools
- Progress tracking including geo-tagged photos
- Communication and collaboration features
⚠️ IMPORTANT: The Platform does NOT:
- Guarantee award of work or project outcomes
- Act as a contractor, consultant, or project manager
- Supervise site execution or construction activities
- Certify quality, safety, or statutory compliance
3. Eligibility & Registration
To use the Civil Hive platform, you must meet the following requirements:
- Users must be 18 years or older
- Businesses must be legally registered entities with valid documentation
- Users agree to provide accurate and complete information during registration
- One user equals one account (unless explicitly authorized otherwise by the Company)
We reserve the right to suspend or terminate accounts that provide false, misleading, or incomplete information.
4. Role of the Company (Limitation of Liability)
Civil Hive and Quite Ignite act only as a digital intermediary.
- We are not a party to any contract formed between Users on the Platform
- All commercial, technical, legal, and financial obligations are solely between Users
- Any dispute, delay, defect, or non-performance arising from projects is not the Company's responsibility
- The Platform facilitates connections but does not guarantee outcomes
5. Tendering & Bidding Rules
- Clients are solely responsible for the accuracy and completeness of tender details
- Service Providers must perform their own due diligence before submitting bids
- Bid submission does not guarantee award of work
- Clients may accept, reject, or cancel tenders at their sole discretion
The Company Does Not Verify:
- Technical feasibility of projects
- Financial capability of parties
- Statutory approvals or compliance requirements
- Accuracy of cost estimates or timelines
6. Scheduling & Progress Tracking Disclaimer
All scheduling and progress tracking features provided on the Platform are indicative planning tools only.
- Schedules generated are user-reported planning tools, not certified timelines
- Progress updates are based on user-reported data
- Geo-tagged photos are for documentation purposes, not certification of work quality
The Company Does Not Guarantee:
- Accuracy of progress reports or documentation
- Completion timelines or project milestones
- Productivity norms or quality standards
- Compliance with contractual or statutory requirements
7. User Responsibilities
By using the Platform, Users agree to:
- Follow all applicable laws, regulations, and industry standards
- Ensure safety protocols, labor compliance, and quality control on projects
- Upload only genuine, accurate site photos and project data
- Not misuse, falsify, or manipulate platform data or features
- Maintain confidentiality of their account credentials
- Promptly update their profile information when changes occur
- Communicate professionally and respectfully with other Users
8. Prohibited Activities
Users shall NOT engage in the following activities:
- Post fake tenders or submit fraudulent bids
- Upload misleading, falsified, or unrelated photos
- Impersonate other users or entities
- Use the Platform for any unlawful activities
- Scrape, copy, or reverse engineer the Platform or its content
- Attempt to gain unauthorized access to the Platform or other users' accounts
- Transmit viruses, malware, or any harmful code
- Harass, threaten, or abuse other users
- Circumvent or manipulate platform features or security measures
9. Ratings, Reviews & Content
- Reviews and ratings must be honest, factual, and based on actual experiences
- Abusive, defamatory, or false reviews are strictly prohibited
- The Company reserves the right to remove content without prior notice if it violates these Terms
- Users may not post content that infringes on intellectual property rights
- All content posted must comply with applicable laws and regulations
10. Payments & Fees
- Platform fees, subscriptions, or commissions (if applicable) will be clearly disclosed to Users
- All payment transactions are governed by separate payment terms
- The Company is not responsible for payment disputes between Users
- Users are responsible for any taxes applicable to their transactions
- Fees are non-refundable unless otherwise stated
11. Data Ownership & License
Users retain ownership of their data uploaded to the Platform.
By using the Platform, Users grant the Company a non-exclusive, royalty-free, worldwide license to:
- Store and maintain user data
- Display data to relevant parties on the Platform
- Process data to provide Platform services
- Analyze data in anonymized form for platform improvement and insights
This license continues for as long as the data remains on the Platform and for a reasonable period thereafter for backup and legal compliance purposes.
12. Account Suspension & Termination
The Company may suspend or terminate user accounts for:
- Violation of these Terms and Conditions
- Fraudulent activity or misrepresentation
- Legal or regulatory requirements
- Prolonged inactivity
- Behavior that harms other users or the Platform's reputation
Users may terminate their accounts at any time through the Platform settings. Upon termination, certain data may be retained for legal and compliance purposes.
13. Indemnification
Users agree to indemnify and hold harmless Quite Ignite, Civil Hive, and their officers, directors, employees, and agents from any and all:
- Claims and demands
- Losses and liabilities
- Damages and costs
- Legal fees and expenses
arising from or related to the User's use of the Platform, violation of these Terms, or infringement of any third-party rights.
14. Limitation of Liability
The Company shall not be liable for:
- Project delays, cancellations, or changes
- Financial losses incurred by Users
- Safety incidents or accidents on project sites
- Contractual disputes between Users
- Data loss due to user actions or technical issues
- Indirect, incidental, or consequential damages
- Actions or omissions of other Users
- Force majeure events beyond our control
To the maximum extent permitted by law, the Company's total liability for any claims shall not exceed the fees paid by the User in the preceding 12 months.
15. Intellectual Property
All intellectual property rights in the Platform, including but not limited to software, design, logos, and content, belong to Quite Ignite. Users may not:
- Copy, modify, or distribute Platform content without permission
- Use the Civil Hive name, logo, or branding without authorization
- Create derivative works based on the Platform
16. Privacy and Data Protection
Use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of data as described in the Privacy Policy.
17. Modifications to Terms
The Company reserves the right to modify these Terms at any time. Users will be notified of material changes through the Platform or via email. Continued use of the Platform after such modifications constitutes acceptance of the revised Terms.
18. Dispute Resolution
In the event of any dispute arising from these Terms or use of the Platform, parties agree to first attempt resolution through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or litigation as specified below.
19. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Karnataka (INDIA).
The courts of Bengaluru shall have exclusive jurisdiction over any disputes arising from these Terms or use of the Platform.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
21. Entire Agreement
These Terms constitute the entire agreement between Users and the Company regarding use of the Platform and supersede all prior agreements and understandings.
